NT PLANNING SCHEME - BACKGROUND
The initial Planning Scheme limited all Bed & Breakfast accommodation throughout the Territory to a maximum of 5 visitors. The then NT Bed & Breakfast Council (later to become BBFNT and then BBFAA NT Division) objected to this limitation and welcomed the opportunity to make written and verbal submissions to the Review of the NT Planning Scheme 2007.
NT PLANNING SCHEME SECTION 3, CLAUSE 7.10.1,2 - 2007
" 1. The purpose of this clause is to ensure that bed and breakfast accommodation does not dectract from the amenity of the locality in which the use is established.
2. A dwelling may be used for bed and breakfast accommodation where:
(a) the dwelling is suitable for the use;
(b) the use is accommodated within the existing dwelling;
(c) the person or persons operating the use reside in the dwelling;
(d) no sign is displayed, other than a business sign that is not more than 0.5m2 in area;
(e) not more than three bedrooms are utilised for bed and breakfast accommodation."
BBFAA NT Division has strongly objected to the above definition of a B&B as it is not consistent with the current Australian understanding of what a B&B is, eg most Australians prefer to have a building separate to that of the operator. BBFAA NT Division has also objected to the limitation of (e) - even though (3) allows for an application to the Consent Authority to extend this.
JANUARY 2011 UPDATE
Executive members of BBFAA NT Division are having productive meetings with representatives from the NT Department of Planning and Infrastructure to have our issues addressed.
